1. Acceptance of Terms
By accessing, registering for, or using any course, program, or learning content offered by Ultra Tendency Academy GmbH ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not access or use our services.
These Terms apply to all users, including visitors, registered learners, and any other persons who access our platform or purchase our courses.

3. Description of Services
Ultra Tendency Academy GmbH offers online educational courses and programs (collectively, "Courses") delivered through third-party learning platforms. The content, scope, duration, and materials of each Course are described in the respective course listing at the time of purchase.
We reserve the right to update, modify, or supplement course content at any time in order to improve quality or reflect current developments in the subject matter. Such changes do not constitute a material change to the agreed service.
4. Enrollment and Course Access
4.1 Enrollment
By completing the purchase process, you enter into a binding contract with Ultra Tendency Academy GmbH for access to the selected Course. Enrollment is personal and non-transferable.
4.2 Access Period
Unless otherwise specified in the course description, access to course materials is granted for the duration of the respective program. After the access period expires, you may no longer be able to view course content. We are not obligated to provide extended access beyond the agreed term.
4.3 Technical Requirements
You are responsible for ensuring you have the necessary hardware, software, and internet connection to access the Course. We do not guarantee compatibility with all devices or browsers.
5. Pricing and Payment
5.1 Course Fees
All prices are stated in EUR and are inclusive of any applicable taxes, unless otherwise indicated. The applicable price is the one displayed at the time of your purchase.
5.2 Payment Options
Depending on the Course, we may offer the following payment options:
· Full payment in a single transaction
· Installment payments (where available, typically split into 3 installments)
All payment options and their conditions will be clearly presented during checkout. By selecting an installment plan, you agree to all scheduled payment amounts and dates.
5.3 Payment Processing
Payments are processed by our payment service provider, Stripe Payments Europe, Ltd. By completing a purchase, you also agree to Stripe's terms and privacy policy. We do not store your full payment details.
5.4 Failed Payments
In the event of a failed or declined payment, we reserve the right to suspend or restrict access to the Course until outstanding amounts are settled.
6. Right of Withdrawal and Cancellation
6.1 Statutory Right of Withdrawal
If you are a consumer within the meaning of applicable consumer protection law, you may have a statutory right to withdraw from your purchase within 14 days of the conclusion of the contract, without providing any reason.
6.2 Waiver of Withdrawal Right for Digital Content
By expressly requesting immediate access to course content and acknowledging that you thereby waive your right of withdrawal, you agree that the right of withdrawal expires upon the start of performance of the contract. This waiver will be confirmed at the time of checkout.
For customers in the European Union: This waiver is conducted in accordance with Art. 16(m) of Directive 2011/83/EU.
6.3 No Refunds After Access
Once access to course content has been granted and the right of withdrawal has been waived, no refunds will be issued, except where required by mandatory applicable law or as expressly agreed in writing by us.
7. Intellectual Property and License
7.1 Ownership
All course content, including but not limited to videos, texts, graphics, presentations, worksheets, and audio recordings, is the exclusive intellectual property of Ultra Tendency Academy GmbH or its licensors and is protected by applicable copyright and intellectual property laws.
7.2 Personal License
Upon enrollment, you are granted a limited, non-exclusive, non-transferable, personal license to access and use the course materials for your own private, non-commercial learning purposes only.
7.3 Prohibited Uses
You may not:
· Share, distribute, sell, or sublicense any course materials to third parties
· Share your login credentials or account access with others
· Record, copy, screenshot, or reproduce course content in any form
· Use course materials for commercial purposes or public presentation without prior written consent
8. User Conduct
You agree to use our Courses and platform in a respectful and lawful manner. You will not engage in any conduct that disrupts, harms, or interferes with other users, our staff, or our platform operations.
We reserve the right to suspend or terminate your access without refund in the event of a material breach of these Terms, including any misuse of course materials or misconduct.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Ultra Tendency Academy GmbH shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use our Courses.
Our total liability for any claim arising in connection with these Terms shall not exceed the amount paid by you for the relevant Course.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
10. Disclaimer
Our Courses are provided for educational and informational purposes only. Results may vary depending on individual effort, background, and circumstances. We do not guarantee specific outcomes, professional success, or financial results from participation in any Course.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Courses, you consent to the data practices described in our Privacy Policy.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. We will notify registered users of material changes via email or through the platform. Your continued use of our Courses after the effective date of any changes constitutes your acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. To the extent permitted by law, the courts of Germany shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms.
If you are a consumer, the mandatory consumer protection provisions of your country of residence may also apply.
